Brazil opens new PPH application opportunities starting April 2025

The Brazilian National Institute of Industrial Property (INPI) has announced the opening of new opportunities for filing Patent Prosecution Highway (PPH) applications for the second quarter of 2025. This measure was published in Official Gazette No. 2829 on March 25, 2025, and marks an important step for applicants seeking to expedite patent processing in Brazil.

As of April 1, 2025, 800 additional PPH application slots will be made available, in addition to those already offered in the first quarter of the year. These opportunities will be offered on a quarterly basis until the annual limit of 3,200 applications is reached under the 2025 PPH program.

Of the total available slots, 140 will be allocated to patent applications classified under IPC code H04, which corresponds to the telecommunications sector. The acceptance of PPH applications under IPC H04 and other IPC classes will be reviewed and updated quarterly, allowing adjustments based on demand or INPI’s internal criteria.

If a request for expedited prosecution is inadmissible due to exceeding the application limit, the applicant will have the right to request a refund of the official fee. Furthermore, the applicant will be allowed to submit a new PPH application during the next available window.

This announcement is particularly relevant for foreign patent holders seeking to expedite protection in Brazil through PPH agreements with other intellectual property offices. The quarterly submission structure, along with the possibility of fee refunds, provides greater flexibility and efficiency to the system.
