Brazil updates trademark fees and procedures: new INPI rules effective from August 2025

Brazil’s INPI has introduced significant updates to its trademark system, effective as of August 2025. Changes include new fees, services, automation, and special benefits for specific applicant profiles.

The Brazilian Patent and Trademark Office (BPTO) announced, during the meeting held on June 13, 2025, significant amendments to the procedures and fees applicable to the registration and management of trademarks in Brazil. These changes will come into effect on various dates throughout the second half of 2025, starting on August 7.

The new Fee Schedule, which also includes discounts based on applicant profiles, was established by BPTO Ordinance No. 10/2025, published on May 12. The average adjustment was 24.1%, below the accumulated 102.4% IPCA/IBGE inflation rate between January 2012 (date of the last general adjustment) and December 2024.

Below, we present the main changes and key dates impacting trademark processes:

1. Discount policy

The discount policy is expanded for certain applicant profiles:

100% discount on specific services for:
  • Individuals in vulnerable situations registered in the Cadastro Único (CadÚnico).
  • Persons with disabilities registered in the Federal Government’s Disability Reference Datab.
50% discount applicable to:
  • Natural persons without participation in companies related to the filed request.
  • Microenterprises, individual microentrepreneurs, and small businesses;
  • Simple Innovation Enterprises.
  • Scientific, technological, and innovation institutions (ICTs);
  • Non-profit entities.
  • Public bodies acting on their own behalf.

2. Discontinued services

Following the new regulatory framework, the following services will be discontinued:

  • 377 – Trademark Search Certification by Class
  • 347 – Trademark Search Certification by Holder

3. New services (Starting August and December 2025)

From August 7, 2025:
  • 3019 – Priority processing of trademarks eligible for fee exemption → BRL 0,00
  • 3020 – Priority processing of trademarks for strategic or public policy reasons → BRL 890,00

These services will create new priority queues for trademark examination, fostering innovation and reducing litigation, following the model already applied in patents.

From December 20, 2025:
  • 3021 – Evidence of acquired distinctiveness documents → BRL 4.700,00

Allows registration of signs that initially lack distinctiveness but have acquired it through effective market use, according to article 122 of the Industrial Property Law (LPI).

  • 3022 – Opposition with restricted allegations (conflict with third-party registered trademark) → BRL 360,00 por clase

Limits opposition content to objective allegations concerning conflicts with registered trademarks, aiming to increase productivity and reduce backlog.

4. New fees for trademark applications

From September 20, 2025, the fee paid upon filing will automatically include registration grant and certificate issuance, with no additional subsequent payment required.

*Codes 3011 and 3012 refer to fees charged by WIPO’s International Bureau to foreign applicants using the Madrid Protocol to file trademarks in Brazil.

5. Automation of the first decade and certificate

  • Previous rule: After grant, the user had to pay for the registration certificate and first decade (codes 372, 373 or 3012). Non-payment resulted in final abandonment of the application.
  • New rule: The first decade fee and certificate issuance will be automatic and free for applications filed from 09/20/2025 under codes 389 (pre-approved specification), 394 (free-text specification), and 3011 (Madrid Protocol designation).
