The EPO updates the PACE programme: accelerated examination from February 2026

The European Patent Office (EPO) has announced a significant update to the PACE programme, which allows applicants to request accelerated processing of European patent applications. As of 1 February 2026, acceleration under PACE will be available only during the examination phase, with the search phase excluded. We review the main changes and their practical implications.
What is the EPO PACE programme?
The PACE programme (Programme for Accelerated Prosecution of European Patent Applications) enables applicants to speed up the prosecution of their European patent applications before the EPO by requesting prioritised handling.
Until now, PACE could be requested both during the search phase and the examination phase. This will change under the revised framework.
The new EPO notice: why is PACE changing?
In a notice dated 16 December 2025, the EPO replaced its previous 2015 communication on PACE. The update reflects the Office’s significantly improved performance, particularly regarding search timelines.
In 2024, the average time to issue the European search report was approximately 5.5 months, reducing the need for accelerated search requests.
Key changes to the PACE programme from 1 February 2026
1. PACE limited to the examination phase
- PACE will no longer be available for the search phase.
- Acceleration may be requested only during examination.
2. New rules for PACE requests
- Only one PACE request may be filed per application.
- The request must be filed exclusively during the examination phase.
- PACE requests are not published and are excluded from public file inspection.
3. EPO commitments under accelerated examination
Where PACE examination is granted, the EPO aims to:
- Issue the next examination action within three months, and
- Send subsequent communications within similar timeframes.
4. Removal from the PACE programme
Applications may be removed from PACE, for example, if:
- A time limit extension is requested,
- Renewal fees are not paid on time, or
- The application is withdrawn or refused.
Scope of application of the revised PACE programme
- The revised PACE rules apply to PACE requests filed on or after 1 February 2026.
- Certain rules on removal and suspension will also apply to pending applications as of that date.
Are there alternatives to PACE acceleration?
Yes. Other acceleration routes remain unchanged and fully available, including the Patent Prosecution Highway (PPH). Depending on the procedural status and prior examination results, these mechanisms may offer strategic advantages.

- Choosing between PACE, PPH or other options requires a case-by-case analysis.
