New Resolution 364/2024 regarding patent priorities in Argentina
The new Resolution INPI 364/2024 requires patent applicants who have claimed priority to report whether it has been granted in the country of origin. Find all the details in our post.
The purpose of this resolution is to optimize the processing time of applications and thus expedite the resolution of those procedures in which the holders have a real interest.
The new provision establishes that holders of pending patent applications at the time of its entry into force, regardless of whether they have paid the substantive examination fee or the status of their application, must report within SIXTY (60) consecutive days whether the claimed priority has been granted in the country of origin.
This requirement will be notified through the Patent Bulletin (it is estimated that it could be in the next bulletin in early September) and the deadline will not be subject to automatic extensions.
If no response is submitted within the indicated period, the application will be considered abandoned. After the deadline, the corresponding administrative act will be issued, which will be published in the Patent Bulletin.
