Novelties regarding patent applications in Argentina
Some of the new resolutions provide “user friendly” ways to meet the sometimes bureaucratic requirements of the National Office.
Over the last weeks, the Argentinian INPI has been moving forward towards the simplicity of prosecution in patent applications, giving the applicants some “user friendly” ways to overcoming objections and meeting deadlines.
One of the main resolutions that has been issued recently is Resolution 268/2019; by which Argentinian INPI has joined the Digital Access Services (DAS) for priority documents.
Therefore , since October 1st, the National Offices is not allowed to collect the electronic certified copies of the priority documents from this services.
On the other hand, since March 2nd 2020, the national Office will also be “depositor Office” for priority documents, giving the chance to other participant offices to collect Argentinian priority documents.
You can check the participant countries of DAS in the following link: WIPO DAS: Participating Offices
Notwithstanding, it is important to keep in mind that a Spanish certified translation of the priority document is still mandatory.
Moving towards the situation of automatic time extensions, the National Office issued a new resolution (Resolution 297/2019) where , fortunately, includes again the automatic time extension for responding to Office Actions.
This resolution has retroactively effects for patent cases which have a pending office action.
