"Copyright" is the legal term for the rights granted to creators for their literary and artistic works.

Copyright protects the original work from the moment it is created and fixed in a tangible medium, such as paper, canvas, digital file, etc. They are exclusive prerogatives and privileges of a personal and patrimonial nature.

In most countries, and in accordance with the Berne Convention (the main international treaty for the protection of copyright in literary and artistic works), copyright protection is obtained automatically, without the need for registration or other formalities.

However, it is highly advisable to register copyrights with the competent authorities of the country in question, since having a certificate of registration makes it easier to prove one’s right to take legal action and defend copyrights. For instance, in Mexico there is the National Copyright Institute (INDAUTOR) and in Spain there is the Intellectual Property Registry.

The author must fulfill a series of formal requirements, fill out some forms and pay official fees to obtain his copyright certificate.

With the constant advancement of technology and the digital age in which we live, there are challenges to the defense and protection of copyrights. There is no need to mention the ease with which digital files can be copied, distributed, and accessed. All this requires the development of appropriate strategies to protect or enforce copyrights, considering international treaties and local laws.
