Authorized Agents by the Ministry of Defense

At Herrero & Asociados, we are officially accredited by the Ministry of Defense as authorized agents to prosecute secret patents. This official recognition allows us to handle inventions whose disclosure must be restricted for national security reasons.

What is a secret patent?

A secret patent is a legal concept established under Spanish Patent Law that suspends the publication and disclosure of an invention for national defense reasons. This type of application follows a special and confidential procedure, and its prosecution can only be carried out by expressly authorized agents.

When is it necessary to handle an invention as secret?

This type of protection—classified as a secret patent—is determined by the Spanish Ministry of Defense, or may be designated as such by the defense authorities of NATO countries. It applies to inventions that may have sensitive military or strategic applications, or whose public disclosure could compromise State security. Common situations include:

  • Technologies with dual use (civil and military)
  • Defense devices, cryptography, or secure telecommunications
  • Artificial intelligence systems applied to security
  • Aerospace technologies or drone control systems
  • Etc.
